Definitions
OEM Program Parts. “OEM Program Parts” means parts sourced through manufacturer-backed programs, including without limitation the Genuine Apple Parts Program (GAPP), Samsung ISP, and Google Authorized Repair Programs.
Warranty Coverage
- Parts Warranty (Non-OEM Program Parts). FixMY provides a lifetime, parts-only warranty on non-OEM Program Parts installed by FixMY against defects in materials under normal use. This coverage applies to the part itself and does not include labor beyond the ninety (90)-day Labor Warranty in §2.2.
- Labor Warranty. FixMY warrants workmanship for ninety (90) days from the date of Service. If a defect attributable to workmanship arises within that period, FixMY will, at its option, re-perform the Services or correct the defect at no additional charge.
- Non-Transferability. Warranty coverage is provided to the original customer and is not transferable unless required by law.
- Commencement; Effect of Replacement. Warranty periods begin on the date of Service. Any replacement or rework provided under this Policy does not restart or extend the original warranty periods unless we state otherwise in writing.
- Battery Warranty (Non-OEM Program Parts). FixMY warrants eligible replacement batteries for the lesser of (a) two (2) years from the date of Service, or (b) until the battery’s remaining capacity falls below eighty percent (80%) of original design capacity within two (2) years. This warranty applies to the battery part only. After ninety (90) days from the date of Service, standard labor charges apply for removal/installation. Eligibility is conditioned on FixMY’s verification—using device diagnostics or calibrated test equipment—that the battery’s remaining capacity is below 80% within two (2) years of the Service date. This battery warranty does not apply to OEM Program Parts described in §3; such batteries are governed solely by the applicable OEM warranty terms.
- Labor Charges for Parts-Only Warranty After 90 Days. After the Labor Warranty period in §2.2 expires, any warranty service involving a covered part (including diagnosis, removal/reinstallation, resealing/adhesives, calibration, pairing, or related procedures) will incur standard labor charges. The replacement part itself remains covered under §2.1 (or §2.5 for batteries), subject to this Policy.
Limitations for OEM Program Parts
- Manufacturer Terms Govern. OEM Program Parts are governed solely by the applicable manufacturer’s warranty terms (typically limited coverage, e.g., ninety (90) days) and are not eligible for FixMY’s lifetime parts warranty.
- Identification. At the time of service, FixMY will disclose when OEM Program Parts are used and may identify them as “Genuine [OEM] Parts purchased from [OEM].”
- Assistance. FixMY will provide reasonable assistance to initiate any eligible OEM warranty claim. FixMY does not extend, modify, or guarantee OEM warranties.
Claim Window & Duty to Mitigate
- Claim Window. Customer(s) must notify FixMY of a suspected warranty issue within fourteen (14) days of discovery.
- Mitigation. Upon discovery of a suspected defect, Customer must cease use of the affected device/part where reasonable and take commercially reasonable steps to prevent further damage. Failure to timely notify or mitigate may reduce or void coverage to the extent of additional damage.
- Advisory to Preserve Coverage. If Customer suspects a part is failing under warranty, Customer should immediately discontinue use and protect the device from further damage. If the part is physically damaged before FixMY can inspect it, coverage may be denied under §5 as physical damage.
Exclusions
- accidental and/or physical damage, liquid exposure, impact, or misuse occurring after Service;
- software or data issues not directly caused by Services;
- devices or parts altered, opened, or repaired by third parties after Service;
- cosmetic wear, normal deterioration, and consumables;
- batteries outside the Battery Warranty in §2.5, or batteries exhibiting physical/liquid damage, swelling due to damage or misuse, thermal events, or evidence of tampering;
- damage arising from failure to follow the Claim Window & Duty to Mitigate requirements in §4;
- suspected-warranty parts that sustain physical or liquid damage before presentation for FixMY inspection (including continued use after symptoms begin), which reclassifies the failure as physical damage and not warranty-eligible.
Warranty Claim Procedure
- No Receipt Required. FixMY maintains internal records; a receipt is not required to submit a claim.
- Location. Claims should be presented to the same FixMY location that performed the Service unless FixMY agrees otherwise.
- Mail-In Claims; Shipping; Risk of Loss. If a mail-in claim is requested, Customer is responsible for all shipping and insurance costs unless FixMY approves in writing a prepaid shipping label or reimbursement in its sole discretion. Customer may apply for reimbursement or for a prepaid label prior to shipment; approval is not guaranteed and any reimbursement may be limited to the lesser of (i) actual, reasonable shipping costs or (ii) a FixMY-stated cap. Unless FixMY issues a prepaid, insured label and written instructions expressly assuming transit risk, Customer bears all risk of loss, damage, delay, seizure, or misdelivery while in transit to or from FixMY, including losses caused by carriers, customs, or events described in §7.4 (Force Majeure). Customer is responsible for adequate packaging and for using trackable, insured shipment with signature on delivery. Inadequate packaging may void transit-related claims to the extent of the resulting damage. (All mail-in shipping, transit risk, and any reimbursements are subject to §7.3 (Limitation of Liability) and §7.4 (Force Majeure).)
Section 6 Note. This Section 6 is subject to §7.3 (Limitation of Liability) and §7.4 (Force Majeure).
Determination; Remedies; Limitations
- Discretion. All warranty claims are subject to evaluation by FixMY. FixMY, its suppliers, vendors, and/or the applicable manufacturer(s) make the final determination regarding warranty eligibility and coverage.
- Exclusive Remedies. FixMY’s sole obligations, at its option, are limited to repair, replacement with a functionally equivalent part, store credit, or refund not to exceed amounts paid for the covered Service/part.
- Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST DATA, LOST WAGES, LOSS OF USE, BUSINESS INTERRUPTION, SUBSTITUTE DEVICE/RENTAL COSTS, DIMINUTION IN VALUE, OR OTHER ECONOMIC LOSS, AND INCLUDING LOSSES OCCURRING IN TRANSIT AS DESCRIBED IN §6.3, ARISING FROM OR RELATED TO ANY REPAIR, PART, OR WARRANTY CLAIM, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF FIXMY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION ALSO COVERS LOSSES OR DELAYS CAUSED BY EVENTS BEYOND FIXMY’S REASONABLE CONTROL, INCLUDING WITHOUT LIMITATION ACTS OF GOD (E.G., FIRE, FLOOD, EARTHQUAKE, STORM, LIGHTNING), POWER SURGES OR ELECTRICAL FAILURES, NETWORK/INTERNET OUTAGES, SUPPLY-CHAIN DISRUPTIONS, MANUFACTURER FIRMWARE/SECURITY CHANGES, THIRD-PARTY CARRIER MISHANDLING OR LOSS, THEFT, VANDALISM, CIVIL DISTURBANCE, WAR, TERRORISM, EPIDEMICS/PANDEMICS, GOVERNMENTAL ORDERS OR ACTIONS, AND SIMILAR OR COMPARABLE EVENTS. IN ALL CASES, FIXMY’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SERVICE OR PART GIVING RISE TO THE CLAIM. THE FOREGOING LIMITATIONS APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON INCIDENTAL OR CONSEQUENTIAL DAMAGES; IN SUCH JURISDICTIONS, THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
- Force Majeure. FixMY shall not be liable for any failure or delay in performance to the extent caused by events beyond its reasonable control, including Acts of God; natural disasters; fire; flood; severe weather; power outages; utility or network failures; labor disputes; sabotage; war; terrorism; civil unrest; embargoes; pandemics/epidemics; governmental orders; acts or omissions of shippers, carriers, or suppliers; shortages of parts or materials; or other similar events. Performance times shall be extended for the duration of such event plus a reasonable recovery period.
- Return of Defective Parts; Title. FixMY may require return of the defective/replaced part as a condition of warranty service. Returned or replaced parts may become the property of FixMY, its suppliers, or the applicable manufacturer, including for core return or analysis purposes.
Governing Law
This Policy shall be governed by the laws of the State of Utah, without regard to conflict-of-law principles.
Miscellaneous
- Entire Agreement; Amendments. This Policy constitutes the entire warranty agreement and may be amended by FixMY in writing from time to time.
- Severability; No Waiver. If any provision is found unenforceable, the remainder remains in effect. No waiver is effective unless in writing and signed by FixMY.
- Assignment; No Third-Party Beneficiaries. Customer(s) may not assign rights under this Policy without FixMY’s consent. No third party is an intended beneficiary of this Policy.
