FixMY, LLC - Service Terms & Conditions

These Terms govern all repair services provided by FixMY, LLC. Please read them carefully before authorizing service.

Where OEM Program Parts are used, they will be identified as “Genuine [OEM] Parts purchased from [OEM]”. FixMY does not imply endorsement or affiliation with any manufacturer and does not extend or modify OEM warranties.

1. Scope; Estimates; Customer Authorizations

  1. 1.1 Scope. Services may include diagnostics, parts replacement, micro-soldering, cleaning, and related work.
  2. 1.2 Estimates. Any quoted price is an estimate and may change upon further diagnosis; Customer approval is required before proceeding with changes.
  3. 1.3 Ownership / Access; Security Preferences. Customer represents they own the device or have authority to authorize Service. FixMY does not generally request passcodes or require removal of security features. After a repair is completed, Customer may be asked to unlock the device in person so FixMY can verify successful operation, which may delay completion if Customer is unavailable. At Customer's choice, Customer may (i) provide the passcode or (ii) temporarily remove the passcode/security features. If Customer elects to share credentials, FixMY will store them securely, restrict access to authorized personnel, and delete them when no longer needed for the Service.

2. Repair Standards; Training; Tools

FixMY performs Services in accordance with industry best practices and, where applicable, OEM-referenced procedures using lawful access to manufacturer training materials, technical documentation, and recommended tools. FixMY is not certified, authorized, endorsed, or affiliated with any OEM.

3. Adhesives and Seals (All Repairs)

  1. 3.1 Priority Use of OEM Materials. FixMY prioritizes the use of OEM adhesives and seals for all repairs, whether OEM or aftermarket parts are installed.
  2. 3.2 Substitution to Avoid Delay. To avoid unnecessary delays and maintain timely service, functionally equivalent, high-quality aftermarket adhesives or seals may be substituted when OEM materials are unavailable or delayed, unless Customer requests OEM-only materials prior to Service.

4. Water-Resistance Notice

  1. 4.1 Opening Voids OEM Water-Resistance. Any opening of a device may void OEM water-resistance or dust-ingress ratings.
  2. 4.2 Best-Efforts Reseal. FixMY applies seals/adhesives in accordance with §3 and relevant OEM-referenced procedures; however, water-resistance cannot be guaranteed after any repair due to variables outside FixMY's control.
  3. 4.3 Normal Wear & Tear. Water-resistance naturally diminishes over time under normal wear and tear; post-repair water-resistance is not guaranteed and should not be relied upon as future protection.

5. Parts Sourcing; OEM Program Parts

  1. 5.1 Sourcing. Services may utilize new, refurbished, or aftermarket parts of merchantable quality. Customer preferences will be honored when commercially reasonable.
  2. 5.2 OEM Program Parts. Where OEM Program Parts (e.g., GAPP) are used, FixMY will disclose such use and may identify them as “Genuine [OEM] Parts purchased from [OEM].” OEM warranties govern those parts; FixMY does not extend or modify OEM warranties.

6. Data; Testing; Privacy

  1. 6.1 Data Responsibility. Customer is solely responsible for backing up data prior to Service. FixMY is not responsible for lost, corrupted, or inaccessible data under any circumstances.
  2. 6.2 Testing Authorization. Customer authorizes FixMY to power on, test, and operate the device before and after Service for quality assurance.
  3. 6.3 Passcodes & Post-Repair Verification. Customer acknowledges that refusal or delay in providing temporary access (passcode/biometric) may delay turnaround and may limit FixMY's ability to complete full functional testing. Customer may be required to return to the store to unlock the device so FixMY can complete verification.
  4. 6.4 Access Required for Backups / Certain Procedures. Some Services (e.g., data migrations, backups, device restores, calibration or DFU procedures) may require device access or modified security settings. FixMY will notify Customer when such access is needed and will request credentials only for those limited purposes. If consent is not provided, FixMY may decline the specific procedure or proceed with limited Service that may not include backup/migration results.

7. Mail-In Devices & Shipping

  1. 7.1 Customer Pays Shipping. For mail-in Services or warranty claims, Customer pays all shipping/insurance costs unless FixMY approves in writing a prepaid label or reimbursement at its sole discretion. Customer may apply for reimbursement or a prepaid label before shipment; approval is not guaranteed and may be capped as stated by FixMY. (Subject to §10 (Limitations of Liability) and §13 (Force Majeure).)
  2. 7.2 Packaging & Method. Customer must use commercially reasonable, protective packaging; a trackable shipping method; insurance; and signature on delivery. Failure to do so may limit or void transit-related claims to the extent of the resulting damage. (Subject to §10 and §13.)
  3. 7.3 Risk of Loss; Force Majeure. Unless FixMY issues a prepaid, insured label and written instructions expressly assuming transit risk, Customer bears all risk of loss, damage, delay, seizure, or misdelivery while in transit, including those caused by carriers, customs, theft, or events described in §13 (Force Majeure). Even where FixMY provides a prepaid label, FixMY's obligations are limited to submitting and/or cooperating with the carrier's claim process; FixMY is not responsible for any carrier claim denials, limits, or exclusions. (Also subject to §10 (Limitations of Liability).)

Section 7 Note. This Section 7 is subject to §10 (Limitations of Liability) and §13 (Force Majeure).

8. Unclaimed Devices; Storage Fees

  1. 8.1 Abandonment. Devices not collected within thirty (30) calendar days after Customer notification will be deemed abandoned. FixMY may recycle, dispose of, or resell abandoned devices to recover Service and storage costs.
  2. 8.2 Storage Fees. After an initial grace period of fourteen (14) days from notification, storage fees of two dollars (US $2.00) per day may be assessed beginning on day fifteen (15). While not generally applied, such fees may be enforced at FixMY's discretion.

9. Payment; Fees

Diagnostic fees are non-refundable unless expressly waived. Payment in full is due upon completion. Returned checks or charge disputes may incur administrative fees where permitted by law.

10. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST DATA, LOST WAGES, LOSS OF USE, BUSINESS INTERRUPTION, SUBSTITUTE DEVICE/RENTAL COSTS, DIMINUTION IN VALUE, OR OTHER ECONOMIC LOSS, AND INCLUDING LOSSES OCCURRING IN TRANSIT AS DESCRIBED IN §7.3, ARISING FROM OR RELATED TO THE SERVICES OR ANY WARRANTY CLAIM, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF FIXMY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION ALSO COVERS LOSSES OR DELAYS CAUSED BY EVENTS BEYOND FIXMY'S REASONABLE CONTROL, INCLUDING WITHOUT LIMITATION ACTS OF GOD (E.G., FIRE, FLOOD, EARTHQUAKE, STORM, LIGHTNING), POWER SURGES OR ELECTRICAL FAILURES, NETWORK/INTERNET OUTAGES, SUPPLY-CHAIN DISRUPTIONS, MANUFACTURER FIRMWARE/SECURITY CHANGES, THIRD-PARTY CARRIER MISHANDLING OR LOSS, THEFT, VANDALISM, CIVIL DISTURBANCE, WAR, TERRORISM, EPIDEMICS/PANDEMICS, GOVERNMENTAL ORDERS OR ACTIONS, AND SIMILAR OR COMPARABLE EVENTS. IN ALL CASES, FIXMY'S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID FOR THE APPLICABLE SERVICE. THE FOREGOING LIMITATIONS APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON INCIDENTAL OR CONSEQUENTIAL DAMAGES; IN SUCH JURISDICTIONS, THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

11. No OEM Affiliation

FixMY is not an authorized service provider for Apple, Samsung, Google, or any OEM and does not claim affiliation, endorsement, or certification. References to OEM standards are for quality benchmarking only.

12. Governing Law; Venue

These Terms shall be governed by the laws of the State of Utah. Venue shall lie exclusively in the state courts located in Utah County, Utah, or the federal court for the District of Utah, as applicable.

13. Force Majeure

FixMY shall not be liable for any failure or delay in performing the Services or any obligation under these Terms to the extent caused by events beyond its reasonable control, including Acts of God; natural disasters; fire; flood; severe weather; power outages; utility or network failures; labor disputes; sabotage; war; terrorism; civil unrest; embargoes; pandemics/epidemics; governmental orders; acts or omissions of shippers, carriers, or suppliers; shortages of parts or materials; or other similar events. Any quoted or estimated completion dates are estimates only and shall be extended for the duration of such event plus a reasonable recovery period.

14. Warranty Reference

Any warranty related to the Services is governed exclusively by FixMY's separate Warranty Policy, incorporated herein by reference. In the event of any conflict between these Terms and the Warranty Policy regarding warranty coverage, the Warranty Policy controls.

15. Labor on Warranty Parts (Post-90 Days)

For the avoidance of doubt, where a part remains covered under FixMY's parts-only warranty (see Warranty Policy), labor associated with its replacement or related procedures is billable after the ninety (90)-day Labor Warranty period. Standard rates apply unless otherwise agreed in writing.
